Acceptance of Terms of Use

Please read the Terms of Use carefully before you use the Site. By accepting the Terms of Use, you agree to be bound by and abide by these Terms of Use and our Privacy Policy. 

Welcome to the Site, operated by Buttercup Learning (the “Company”, “we”, “us” or “Buttercup”). The following terms and conditions (collectively, these “Terms of Use”), govern your access to and use of any content, functionality and services offered on or through buttercuplearning.com (the “Site”).

By purchasing The Nature Curious Box, a box of nature activity sheets and prints delivered to the subscriber’s door, you accept and agree to be bound by and abide by these Terms of Use.

By purchasing our AR prints and downloadables, you agree to be bound by and abide by these Terms of Use.

If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Site.

Online Purchases and Terms of Sale

To subscribe to any of our subscriptions, buy our AR prints, or download our downloadables, you are required to enter personal information. All of this information is subject to our Privacy Policy.

Eligibility

This Site is for users who are 18 years of age or older. By agreeing to the Terms of Use, you warrant that you are of legal age to form a binding contract with Buttercup Learning and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site. If you are using the Site on behalf of any entity, you further represent and warrant that you are authorised to accept these Terms of Use on such entity’s behalf.

Registration

You are required to create an account in order to purchase from our Site.  You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. 

Subscribing

By subscribing, you agree to pay your subscription fee for the goods that are delivered for the term agreed upon by both parties.

Subscription Renewal

By signing up for a Nature Curious box subscription, you understand and agree that you will be charged at the standard rate and that any promotional codes used as a new customer at signup do not transfer or apply to your renewal fee. 

The Company does not accept any responsibility or offer refunds for ‘auto renewals’ proceeding if you have failed to cancel your subscription before your next renewal date. You understand and agree that you will be automatically billed after your current subscription, either as a seasonal quarterly payment or annually, unless the subscription is ‘set to cancel’ before your final payment date in your initial commitment.

YOUR SUBSCRIPTION IS CONTINUOUS UNTIL YOU CANCEL AND, IF YOU CANCEL YOUR MEMBERSHIP BEFORE THE END OF AN EXISTING SUBSCRIPTION PERIOD, YOU WILL BE CHARGED FOR THE REMAINDER OF THAT SUBSCRIPTION PERIOD.

IF YOU DO NOT CANCEL YOUR MEMBERSHIP PRIOR TO YOUR SUBSCRIPTION RENEWAL. YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR A NEW SUBSCRIPTION PERIOD OF THE SAME AMOUNT OF TIME.

Cancellation

You may cancel your subscription by logging into your account on the Buttercup Learning website at any time by clicking the link  – manage subscription in the website footer. This does not initiate any kind of refund if you fail to cancel before the renewal date.

Your subscription is continuous until you cancel, and, if you cancel your membership before the end of an existing subscription commitment period, you will be charged for the remainder of that subscription period.

By stating you can cancel at any time, Buttercup Learning directly refers to the renewal and not your commitment term..

Buttercup Learning does not offer a ‘free trial’ or ‘£1 trial’ unless stated. You can only cancel after the first box if you select a quarterly subscription. A 12 month subscription is different and you have agreed to stay for the entire subscription period. This policy protects the company from abuse of our discount systems given to new members who want to join up on a new subscription. If you agree to a 12 month subscription, you need to stay for the full commitment period. Normal Quarterly subscriptions can be cancelled at any point.

The Nature Curious Box discounts are one per household.

The Nature Curious Box is a subscription service, by signing up, you agree that it is your responsibility to cancel your own subscription by logging into your account profile. The Company does not accept responsibility to cancel your account on your behalf. It is up to the customer alone to cancel the subscription. Cancellations must be completed before the next renewal date. Annual subscriptions will renew on the same date of the month that you signed up after your commitment period ends. EG You sign up for 12 months on the 5th of June 2023 your membership will automatically renew 12 months later.

You must cancel your subscription 24 hours before the renewal date of the 17th of the month. IF YOU DO NOT CANCEL PRIOR TO THE RENEWAL DATE OF EACH SEASONAL QUARTER, YOU WILL BE CHARGED FOR THAT QUARTER’S SERVICE AND YOU WILL RECEIVE A Nature Curious Box. All cancellation requests received after the renewal date will apply to the following quarter.

Billing & Payments

You will automatically be charged each quarter for your ongoing subscription. If you have committed to a subscription period lasting longer than one quarter (e.g. a twelve month plan), unless you cancel your subscription or membership prior to the end of your then-current subscription period, at the end of that period, your subscription will automatically be renewed for an additional subscription period of the same amount of time.

Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments for our products shall be in U.K pounds.

Prepaid credit / debit cards are not accepted.

For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date, you do not edit your credit card information and you have an ongoing subscription, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to constantly update your payment method information or cancel your membership should you wish to discontinue your purchase of our Products.

Your Personal Data

Your security is paramount to us. We use a reputable third party to process all payments, ‘Stripe Europe Ltd’ and you agree that we can store your information with this party. You also acknowledge that we will not be held responsible for any third party security breaches.

Digital Downloads

Order process

The advertising of downloads on our website constitutes an “invitation to treat”; and your order for downloads constitutes a contractual offer. The download agreement will not come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

In order to enter into the download agreement, you will need to take the following steps: (i) you must add any downloads you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) you must provide your details, confirm your order and give your consent to this agreement; (iii) Stripe will handle your payment; (v) we will send you an email confirming your order (at which point, in each case, this download agreement will come into force). Once the agreement is in force, you will be able to obtain your downloads through the email sent to you..

We will not file a copy of the download agreement specifically in relation to your order. We may update the version of the download agreement on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you print and retain a copy of the download agreement for your records.

The only language in which we provide the download agreement is English.

Before you place your order, you will have the opportunity of identifying whether you have made any input errors. You may correct those input errors before placing your order using the website interface.

(4) Downloads

Our website offers a range of downloadable prints. The downloads may include different sized image files in zip format.

(5) Price and payment

Prices for downloads are quoted on our website. It is possible that some of the prices on the website are incorrect. We will verify prices as part of our sale procedures so that a download’s correct price will be stated when you pay for the download.

Payment must be made upon the submission of your order. We will withhold the downloads if the price is not received from you on time, in full, in cleared funds.

The prices on the website exclude value added taxes (where applicable).

Payment for all downloads must be made through Stripe payment by debit or credit card.

Prices for downloads are liable to change at any time, but changes will not affect download agreements that have come into force.

(6) Your warranties

You warrant to us that:

(a) you are legally capable of entering into binding contracts;

(b) you have full authority, power and capacity to agree to the download agreement;

(c) the information provided in your order is accurate and complete; and

(d) you have or have access to the necessary smart device systems, apps and network connections to receive and enjoy the benefit of the downloads that you purchase.

(7) Licence to use downloads

In this Section, “Prints” means the prints that you purchase from our website; “Website” means a website or software application hosted on and made available to users via the internet, including updated and upgraded versions of such website; and “Digital Product” means a software program, electronic publication or other copyright-protected work that is distributed to users for their own use, including updated and upgraded versions of such Digital Product.

Subject to your payment of the applicable price and compliance with the terms of the download agreement, we grant to you a worldwide non-exclusive licence to make any Permitted Use of any Template; providing that you must not in any circumstances make any Prohibited Use of any Template.

The “Permitted Uses” are:

(a) downloading a copy of each Print;

(b) storing, viewing Prints on one or more computers, 

(c) printing an unlimited number of copies for personal use;

The “Prohibited Uses” are:

(a) the sale, licensing, sub-licensing, renting, leasing or commercial distribution of any print in any format (excluding distribution and use of a Poster as expressly permitted above);

(b) the use of any Print in any way that is unlawful or in breach of any person’s legal rights under any applicable law, or in any way that is offensive, indecent, discriminatory or otherwise objectionable;

(c) the use of any Print to compete with us, whether directly or indirectly.

This licence is non-transferable. 

All rights in the downloads not expressly granted in the download agreement are hereby reserved.

You must retain, and must not delete, obscure or remove, all copyright notices and other proprietary notices placed by us on any Print.

If you breach any of the terms of the download agreement, then the licence set out in this Section will be automatically terminated upon such breach (whether or not we notify you of termination).

Upon the termination of the licence set out in this Section, you will promptly and irrevocably delete from your computer systems and other electronic devices all copies of the Prints in your possession or control, and will permanently destroy any paper or other copies of the Prints in your possession or control.

(8) Consumer rights

Nothing in the download agreement affects any statutory rights you may have as a consumer.

(9) Limitation of warranties

We supply downloadable Prints. These Art prints include a weblink accessed through an Augmented Reality Scanning app. The information contained on the weblink is not intended to be comprehensive. Neither the print nor the website page constitute anything more than suggestions for positive, sustainable action.  Whilst our suggested actions are designed to cover a range of situations, they cannot be expected to be suitable for all situations. Accordingly, we do not give any representations, warranties or guarantees that any of our digital prints you use will be suitable for your circumstances.

Shipping

Our listed prices for our subscription boxes include Free shipping in the UK unless otherwise stated. Our print orders are shipped through Teemill by royal mail or courier, payment is in addition to the cost of the goods purchased.  All orders placed on our website are subject to availability. Products will be shipped according to our Site shipping terms.

Loss of Goods

Royal Mail is responsible for the delivery of all subscription boxes that are ordered. Should your box not arrive within 7 days of your payment renewal date please contact us via email.

Return / Refund Policy

All sales and subscriptions made on our Site are considered final. The Company has a return policy in line with distance selling laws, If there is a problem or defect with any product delivered by Buttercup Learning, we will do our utmost to rectify the problem. Products must be returned unopened, unused and intact. If the products have been opened/used we will not accept a return or offer any refund, By subscribing, you agree to these terms. No refund will be issued for digital download products. Please refer to our FAQ page, or you can contact customer service  – support@buttercuplearning.com

Correspondence

 We send e-mail correspondence and newsletters following orders and registration by members. You can opt out of these at anytime.

Pricing/Errors

Product prices and product availability are subject to change without notice. We may cancel any offer and reserve the right to correct errors, including after an order has been submitted, whether or not your credit/debit card has been charged. If your credit/debit card has already been charged and your order is cancelled, the Company will issue a refund to your credit/debit card account in the amount of the charge. You accept that your subscription being ‘auto renewed’ on the date advised at sign up is not considered an error liable for refund.

Order Acceptance/Confirmation

We reserve the right at any time after receipt of your order to accept or decline your order. The Company reserves the right to decline sales to any party.

Warranty

You are responsible for deciding if the products you receive are suitable for you and your children’s use (including allergies, choking, and all other hazards). We will not offer any compensation under any circumstance.

Site and Contents Ownership

The Site is owned by Buttercup Learning. All of the content displayed on the Site, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software and the selection and arrangement thereof (“The Nature Curious Box”) its licensors or its third-party image partners. All elements of the Site, are protected by copyright, trade dress, moral rights, trademark and other laws relating to the protection of intellectual property.

Modifications And Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you.

You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

Use of the Site

All content is intended for customers of Buttercup Learning. You are prohibited from: (a) copying or re-transmitting any or all of the Site or content without a written agreement from Buttercup Learning; (b) using any data mining, robots or similar data gathering or extraction methods; (c) registering, subscribing, unsubscribing or attempting to register, subscribe or unsubscribe any party for any Buttercup Learning product or service if you are not authorized to do so; (d) modifying any part of the Site (e) disabling or interfering with security-related features of the Site or any system resources, services or networks connected to or accessible through the Site; (f) selling, licensing or leasing any content without specific written authorisation from Buttercup Learning and (g) using the Site other than for its intended purpose. (h) Additionally, you agree not to use the Site or contents in any manner that could damage the reputation of the company.

Trademarks

All logos, designs and trademark and any other product or service name or slogan contained in the Site are trademarks of Buttercup Learning Ltd and its suppliers or licensers, and may not be copied, imitated or used, in whole or in part, without the prior written permission of the company or the applicable trademark holder. In addition, the design of the Site, including all page headers, custom graphics, button icons and scripts, may not be copied, without written permission.

Your participation, correspondence or business dealings with any third party found on or through the Site, regarding the payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that Buttercup Learning  shall not be responsible or liable for any loss, damage or other matters of any sort incurred as the result of any such dealings.

Interactive Services or Areas

By using any Interactive Areas, you agree not to upload or create or otherwise publish through the Site any of the following: a. Any data, information, text, music, sound, comment, photos, graphics, code or other material (“User Content”) that is defamatory, obscene, pornographic, harmful to minors, indecent, lewd, unlawful, invasive of privacy or publicity rights or abusive; b. Viruses, corrupted data or other harmful, disruptive or destructive files; and c. Unsolicited promotions, political campaigning, advertising, junk mail, spam, chain letters, pyramid schemes or solicitations;

User Generated Contributions

The Site and our community sites hosted may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “Contributions”).

Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

1. the creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.

2. you are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.

3. you have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.

4. your Contributions are not false, inaccurate, or misleading.

5. your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.

6. your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).

7. your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.

8. your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another.

9. your Contributions do not violate any applicable law, regulation, or rule.

10. your Contributions do not violate the privacy or publicity rights of any third party.

11. your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.

12. your Contributions do not violate any federal or state law concerning child pornography, or otherwise intended to protect the health or well-being of minors;

13. your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.

14. your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.

Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.

Contribution License

By posting your Contributions to any part of the Site [or making Contributions accessible to the Site by linking your account from the Site to any of your social networking accounts], you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site.

You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions. 

We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Site; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.

Guidelines For Reviews

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria:

(1) you should have firsthand experience with the person/entity being reviewed;

(2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language;

(3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;

(4) your reviews should not contain references to illegal activity;

(5) you should not be affiliated with competitors if posting negative reviews;

(6) you should not make any conclusions as to the legality of conduct;

(7) you may not post any false or misleading statements;

(8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners.

We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

Registration Data and Account Security

By using the Site or subscribing to The Nature Curious Box you agree to: (a) provide accurate information about you on the Site (“Registration Data”); (b) maintain and promptly update the Registration Data, and any other information you provide to Company; (c) maintain the security of your password; (d) notify us immediately of any breach of security connected with your account; (e) accept all responsibility for any and all activities that occur under your account; and (f) accept all risks of unauthorised access to the data and any other information you provide.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Indemnification

You agree to defend, Buttercup Learning affiliates, licensers, subsidiaries, independent contractors, investors, employees, agents, third party information providers and against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) issues arising out of or related to anything connected to the contents of your Nature Curious Box.

You also agree to defend, indemnify and hold harmless Buttercup Learning, its affiliates, licensers, subsidiaries, independent contractors, investors, employees, agents, third party information providers and against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) arising out of or related to anything related to User Content that you post, store or otherwise transmit on or through the Site, your conduct, your use or inability to use the Site, your breach or alleged breach of the Site Terms or of any representation or warranty contained herein, your unauthorised use of the The Nature Curious Box content, or your violation of any rights of another.

Disclaimer

Buttercup Learning will not be liable for any damages of any kind arising from contents contained within your Nature Curious Box (including but not limited to, personal injury, pain and suffering, emotional distress, choking, medical complaints, death or injury to any animal or person). Children must be monitored at all times when using the contents of The Nature Curious Box and should always be supervised. Our products are only intended for their original purposes. You accept responsibility to keep the contents away from all of the above.

You, not Buttercup Learning, assume the entire cost of all necessary, medical bills, or any arising legal fees or bills whatsoever due to your subscription to The Nature Curious Box.

Buttercup Learning will not be liable for any damages of any kind arising from the use of the site or content, including, but not limited to lost profits, and direct, indirect, incidental, punitive and consequential damages. We make no warranty that the site is free from infection by viruses or anything else that has contaminating or destructive properties.

Scientific, sustainable and conservation Information presented on this site, in our prints, books and augmented reality is correct at the time of publishing. Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date. To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

Limitation of Liability

In no event shall Buttercup Learning, it’s directors, investors, employees or agents be liable for any direct, indirect or consequential damages, or any other damages of any kind, including but not limited to death, illness, medical complaints, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the site, our products, the services, The Nature Curious Box Content or the materials contained in or accessed through the site, including without limitation any damages caused by mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorised access to Buttercup Learning records, programmes or services. 

UK law shall apply to these Terms, and the parties agree to submit all disputes between them to the exclusive jurisdiction of the UK courts.

Termination

Buttercup Learning reserves the right, without notice and in its sole discretion, to terminate your account/subscription and/or to block your use of the Site. We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.

In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

Changes to Site Terms

Buttercup Learning reserve the right to change any of the terms and conditions contained in the Terms of Use or any policy or guideline of the Site, at any time and in its sole discretion. Any changes will be effective immediately upon posting on the Site.
